The United States Patent and Trademark Office (USPTO) has officially announced that, pursuant to the authority granted by the U.S. Trademark Act, it will establish or increase certain trademark fees, which will take effect on January 18, 2025. The reason for this adjustment is to secure sufficient funding for the effective administration of the U.S. trademark registration system. Against the backdrop of the current economy facing higher-than-expected inflation, operating costs have risen significantly.

1. Application:The fee will increase from $250 per mark per class to $350 per mark per class.

The USPTO will discontinue the two electronic filing methods, TEAS Plus and TEAS Standard, and replace them with a single electronic filing method instead.


2.  Surcharge Fees:The USPTO will charge an additional fee of $100 per mark per class for cases involving insufficient information in applications. The Final Rule outlines 20 scenarios of insufficient information, including (but not limited to) the following: failure to describe the logo for a graphic trademark, failure to specify colors for a colored design trademark, failure to provide an English translation for non-English trademarks, failure to submit a written consent form when the trademark consists of a specific individual’s name, submission of a signed declaration document that does not comply with official regulations, and failure to provide prior registered trademarks with the same name. For applications using custom goods or services items, the fee will be $200 per mark per class.

3. AAU and SOU:Will increase from $100 per mark per class to $150 per mark per class

4. Section 8:Will increase from $225 per mark per class to $325 per mark per class

5. Section 15:Will increase from $200 per mark per class to $250 per mark per class

6. Section 9:Will increase from $300 per mark per class to $325 per mark per class

7. Letter of Protest Fee:Will increase from $50 per mark per class to $150 per mark per class

8. Petition to Director:Will increase from $250 per mark per class to $400 per mark per class

9. Petition to Revive:Will increase from $150 per mark per class to $250 per mark per class

Businesses involved in these services must pay close attention to the fee adjustment. In particular, for trademarks previously filed as intent - to - use applications, if you are now allowed to submit evidence, you must complete and file the application by January 18 next year; otherwise, the applicable fees will change. Additionally, regarding the Section 8 Declaration (five - year declaration), if the filing period has arrived, submit it as soon as possible.
